AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and PoolTile.ca (“we”, “us”, or “our”), concerning your access to and use of the https://www.pooltile.ca website or landing page, as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Definitions and Key Terms

To help explain things as clearly as possible in these Terms & Conditions, every time any of these terms are referenced, they are strictly defined as:

Cookie: Small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics, and remember information about you such as your language preference or login information.

Company: When these terms mention “Company,” “we,” “us,” or “our,” it refers to PoolTile.ca, which is responsible for your information under these Terms & Conditions.

Country: Refers to Canada, where PoolTile.ca and its owners/founders are based.

Device: Any internet-connected device such as a phone, tablet, computer or any other device that can be used to visit www.pooltile.ca and use the services.

Service: Refers to the services provided by PoolTile.ca as described in the relevant terms (if available) and on this platform.

Third-party service: Refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.

Website: PoolTile.ca’s site, which can be accessed via this URL: https://www.pooltile.ca

You: A person or entity that is registered with PoolTile.ca to use the Services.

PoolTile.ca (“we” or “us”) operates a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions (the “Mobile Messaging Terms”). The Program and our collection and use of your personal information are also subject to our Privacy Policy. By enrolling, signing up, or otherwise agreeing to participate in the Program, you accept and agree to these Mobile Messaging Terms and our Privacy Policy.

Messaging Program Description

We may send promotional and transactional mobile messages in various formats through the Program. Promotional messages advertise and promote our products and services and may include promotions, specials, other marketing offers, and abandoned checkout reminder transactions. Transactional messages relate to existing or ongoing order notifications and updates, such as appointment reminders. Mobile messages may be sent using automated technology, including an autodialer, automated system, or automatic telephone dialing system. Message frequency will vary but will not exceed 20 messages per month. You agree that we, our affiliates, and any third-party service providers may send you messages regarding the above topics or any related matter, and that such messages and/or calls may be sent using different telephone numbers or shortcodes. We do not charge for mobile messages sent through the Program, but you are responsible for any message and data rates imposed by your mobile provider, as standard rates may apply for SMS and MMS alerts.

User Opt-In

By providing your mobile phone number to us, you are voluntarily opting into the Program and you agree to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if such number is registered on any provincial or national “Do Not Call” list. You agree that any mobile phone number you provide to us is a valid mobile phone number for which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the number, you agree to promptly notify us at +1 (800) 577-7751. Your participation in the Program is not required to make any purchase from us and your participation in the Program is completely voluntary.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service is permitted.

 All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

User Opt-Out and Support

You may opt out of the Program at any time. If you wish to stop receiving mobile messages from us, or you no longer agree to these Mobile Messaging Terms, reply STOP, QUIT, CANCEL, OPT-OUT, and/or UNSUBSCRIBE to any mobile message from us. You may continue to receive text messages for a short period while we process your request and you may receive a one-time opt-out confirmation message. You understand and agree that the foregoing is the only reasonable method of opting out. For support, reply HELP to any mobile message from us.

Our mobile messaging platform may not recognize requests that modify the above commands, and you agree that we and our service providers will not be liable for failing to honor requests that do not comply with these terms. We may also change the telephone number or shortcode we use to operate the Program and will notify you of any such change. You acknowledge that requests sent to an outdated number or shortcode may not be received, and we are not responsible for failure to process such requests.

Disclaimer of Warranty and Liability

The Program is offered on an “as-is” basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Program.

Modifications

We may modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Mobile Messaging Terms at any time. Any such modification will take effect when posted to our website. You agree to review these Mobile Messaging Terms periodically to stay aware of any changes. Your continued participation in the Program constitutes your acceptance of those modifications.
